Terms of Service

1. Who we are
TreeLead is operated by [Registered company name], registered at [Registered address] (GB) ("TreeLead", "we", "us"). These terms govern your use of the TreeLead service (the "Service"). By creating an account or using the Service you agree to them. If you are using the Service on behalf of a business, you confirm you have authority to bind that business, and "you" in these terms means that business.
2. What the Service does
TreeLead helps web professionals and agencies find prospective clients, generate AI-assisted website concepts and proposals, manage a sales pipeline, send outreach subject to built-in compliance checks, and collect payment from their own clients. It is a tool you use to run your own sales and client-management process — TreeLead is not a party to, and takes no responsibility for, the underlying business relationship between you and the businesses you contact or contract with.
3. Your account
You must provide accurate information when creating an account and keep your login credentials confidential. You are responsible for all activity under your account, including actions taken by team members you invite. Tell us promptly if you suspect unauthorised access.
4. Subscriptions and billing
The Service is offered on subscription plans (including a Free plan with limited usage), billed monthly or annually in advance, in the currency shown for your region at checkout. Paid plans renew automatically at the end of each billing period unless cancelled before renewal. Cancelling stops future renewals; it does not refund the current period unless required by law. We may change plan pricing or features going forward, with notice before it applies to you — changes never apply retroactively to a period you have already paid for.
Each plan has monthly usage limits (for example, on AI generations and business searches). We may block an action that would exceed your plan's limit and prompt you to upgrade; we do not charge extra for exceeding a limit without your action to upgrade.
5. Collecting payment from your own clients
If you connect a payment provider (currently Stripe, with MercadoPago planned) to collect payment from your own clients, funds settle directly into your own connected account — TreeLead never holds or has custody of that money. TreeLead charges a platform fee, currently 2%, deducted automatically from each payment processed this way; this is disclosed to you before you create a payment plan. You are solely responsible for the accuracy of amounts you invoice, for any tax obligations arising from payments you collect, and for your relationship with the paying client. Payment processing is also subject to the relevant payment provider's own terms.
6. Outreach and compliance
The Service includes tools intended to support lawful outreach — consent and suppression list checks, opt-in tracking, and jurisdiction-aware rules — but these are decision support, not legal advice, and self-certified by you. You remain solely responsible for complying with applicable marketing, spam, and data protection law (including PECR, the UK and EU GDPR, CAN-SPAM, and equivalent laws in any jurisdiction you contact) in every message you send. We may suspend outreach features on your account if we reasonably believe they are being used unlawfully.
7. AI-generated content
Website concepts, proposals, and follow-up messages generated using AI are starting points, not finished, verified output. AI-generated content can be inaccurate, generic, or unsuitable for a specific recipient. You are responsible for reviewing and editing any AI-generated content before sending it or presenting it to a third party.
8. Acceptable use
You agree not to:
- Use the Service to send unlawful, unsolicited, or deceptive communications;
- Attempt to bypass the Service's compliance or usage-limit checks;
- Reverse engineer, scrape, or resell the Service without our written consent;
- Upload data you do not have the right to process; or
- Use the Service to build a competing product.
9. Intellectual property
We own the Service and its underlying software and design. You own the data you put into it (your prospects, notes, and proposals) and grant us only the licence needed to operate the Service on your behalf, including sending your data to the third-party providers listed in our Privacy Policy.
10. Third-party services
The Service relies on third-party providers to function — currently including Supabase (database and authentication), Stripe and MercadoPago (payments), Resend (email delivery), Google Places (business discovery data), Anthropic and/or OpenAI (AI generation), Sentry (error monitoring), and Vercel (hosting). Their own terms and privacy practices apply to the parts of the Service they provide, and we are not responsible for their downtime or errors, though we will try to keep the Service working around them.
11. Termination
You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access if you materially breach these terms — including unlawful use of outreach features — and will give notice where reasonably possible. On termination, your right to use the Service ends; see our Privacy Policy for how long we retain your data afterward.
12. Disclaimers and liability
The Service is provided "as is". We do not guarantee that AI-generated content is accurate, that outreach sent through the Service is compliant with every applicable law, or that the Service will be uninterrupted or error-free. To the fullest extent permitted by law, TreeLead is not liable for indirect, incidental, or consequential losses, or for the acts of the businesses or clients you contact through the Service. This section does not limit any liability that cannot lawfully be limited, including for death, personal injury caused by negligence, or fraud.
13. Governing law
These terms are governed by the law of England and Wales, and the courts there have exclusive jurisdiction over any dispute, without prejudice to any mandatory consumer protections you may have in your own country of residence.
14. Changes to these terms
We may update these terms as the Service evolves. We will give notice of material changes (for example, by email or an in-app notice) before they take effect. Continuing to use the Service after a change takes effect means you accept it.
